AGO conducts its weekly High Council Meeting

The High Council Meeting of Attorney General’s Office (AGO) led by Sarnpooh Mohammad Farid Hamidi, Attorney General of Islamic Republic of Afghanistan, met on Sunday, January 29, 2017, in the presence of deputies and members of AGO High Council, to decide important issues of AGO.

Initially the Council discussed, a suggestion of Cadre General Directorate of Crimes against Internal and External Security regarding superannuation wages of officers with military ranks. Due to multiplicity of laws, decree issues, and provision of service interruptions during the Taliban regime the issue faced problems. AGO High Council decided that a committee should be appointed to clarify superannuation wages of officers with military ranks. The committee was assigned to prepare a request for instructions by next week which will be sent to the Supreme Court after scrutiny and assessment by the AGO High Council.

Members of the High Council discussed suggestion number (66) of Military Primary Prosecution Office, Counter-administrative Corruption Special Prosecution Office of Justice and Judicial Center regarding AGO properties, under supervision of Public Rights Division, and Primary Court Directorate of 4th Municipality District.  The High Council decided that a board of authorities including Municipality and Afghanistan Independent Land Authority for identification and consolidation of the property. The board should find out why the litigant received 812 square meters instead of 325 square meters, and present results of their survey in the next meeting.

Members of the High Council reviewed and discussed a request for instruction number (2473) of Ghazni Province Appellate Prosecution Office regarding the cases sent by Audit Department of Education Ministry, regarding the assessment of cases belonging to civil services staff recruitment. The High Council decided to act according to article 28 of decree of Civil Services Staff Law.

A letter of Prosecution Office for Overseeing the Provisions Enforcement, requesting instructions of Parwan Province Appellate Prosecution Office about (3) prisoners was discussed. Based on the request for instructions, one case was injury led to death and two other cases were murder. In murder case, the release, and considering rights of the victim, there is no Sharia release order for them. The High Council must decide if they deserve commutation or not.  The High Council assigned Directorate of Provision’s Enforcement to determine exact information on commutation and present at the next meeting of the High Council.
