AGO Convicted Two Staff of Herat Brishna for Embezzlement, Falsification, and Bribery

Two Staff of Herat Brishna along with a commissioner convicted on the charges for Embezzlement, falsification and bribery.

Herat’s Public Security Primary Court trialed Mohammad Ismail son of Mohammad Nasir, Nor Aqa son of Sayad Osman and Wakil Ahmad son of Sheer Ahmad on the 29th of August 2019.

The perpetrators of this case were arrested on 8th January 2019 by the detective organs and were referred to Herat Prosecution Office for further investigation and ensuring justice.

According to the lawsuit prepared by the assigned prosecutor, two of the employees of Herat Brishna and a commissioner were charged for distributing of electricity meter to the citizen against 10,000 AFN, while they were paying only 3,700 AFN to the governmental account and distributing the rest of the money among themselves.

The assigned prosecutor completed the investigation and filed the lawsuit, based on the documents and proofs against the defendants for embezzlement, falsification, and bribery; asked the Judicial Board to implement Articles 453, 438, 391, 73 and 58 of the Penalty Code on them.

The Judicial Board of the Public Security Primary Court, convicted Noor Aqa son of Mohammad Ismail on the charges of taking bribery of amount of 15,450 AFN, falsification in three appendage form of electricity meter and embezzlement in accordance with the Article 73 of the Penalty Code for one year and six months of custodial imprisonment and paying of 15,450 AFN as a cash fine equivalent to the bribery and detachment from duty.

Also, the Judicial Board convicted Wakil Ahmad on the charge of assisting in preparing of the three appendage forms of electricity meter, interfering in public duties and giving bribery of amount of 15,450 AFN, in accordance with the Article 73 and 78 of the Penalty Code to one year and six months of custodial imprisonment and paying of 77,250 AFN as a cash fine and additionally 15,450 equivalent to the bribery.
