Kabul Primary Court Trials Five employees of Maiwand 215 Corps
On July 13 2017, Kabul Primary Court trialed Lieutenant General Mohammad Moin Faqir, former commander of Maiwand 215 Corps, Brigadier General Fazil Rahman Andarabi, former commander of 1st and 2nd Regiment, Colonel Mohammad Ibrahim, former audit manager of the mentioned Corps, Colonel Zabiullah, finance manager and Colonel Ghulam Faqir, Detective manager of Maiwand 215 Corps in the Justice and Judicial Center.
The court sentenced Mohammad Moin Faqir for the charge of misuse of duty authority and personal use of six government vehicles to 3 years imprisonment according to article 39 (2) of Military Penal Code. He was further sentenced to 2 years of imprisonment for the charge of misusing official authority, receiving and utilizing 2,000 liters of fuel according to article 39 (2) of the mentioned law. As the embezzled fuel has been used in the mentioned vehicles, the court sentenced the accused to 3 years and 1 month imprisonment in accordance with article 156 of the Military Penal Code.
Meanwhile, the court sentenced him to one year and two months imprisonment for the charge of illegal recruitment of soldiers in Maiwand 215 Corps, based on article 39 (1) of Penal Code, and to one year imprisonment for the charge of receiving bribe from a contractor in return for granting the foodstuff contract according to article 39 (1) of Military Penal Code.
Hence, Mohammad Moin Faqir was totally sentenced to five years and three months imprisonment according to article 158 of Penal Code. He was also fined 669,150 AfN Equivalent to price of the embezzled fuel as compensation to the government based on article 6 (2) of the Penal Code and observing article 10 of the Military Penal Code.
The primary court sentenced Fazil Rahman Andarabi to one year and 2 months imprisonment for the charge of facilitating in misuse of official authority and receiving bribe to grant the foodstuff contract for three months to a contractor company in 2015, based on article 39 (1) of Military Penal Code and observing article 39 of Penal Code.
In a similar case, the court sentenced the accused to 2 years imprisonment for the charge of another contract grant for the Months of March, April, May and June, 2016, based on article 39 (2)of Military Penal Code, totally making three years and two months imprisonment based on article 158 of Penal Code.
He was also fined AFN32, 80,734 according to article 6 of Penal Code observing article 10 of Military Penal Code.
Kabul Primary Court acquitted Mohammad Ibrahim, Zabiullah and Ghulam Faqir for insufficient evidence. The court terminated charges on Abdul Rauf, Logistics officer of the mentioned Corps because of his death according to article 71 of Penal Code.
Lastly, Major Abdullah, Livelihood Department Officer, Lieutenant Colonel Mirwais Ibrahimkhil, Garrison’s logistics officer,
Colonel Noor Mohammad Peerdadkhil, the Garrison 2nd Regiment’ Commander, Major Abdul Alim, Logistics Manager of the 2nd Corps, and the contractors of this Corps are being prosecuted.
