AGO holds Weekly High Council Meeting
The meeting of the High Council of Attorney General’s Office (AGO) held under directorship of Mohammad Farid Hamidi, the Attorney General (AG) of Afghanistan, on August 29, 2016. The meeting was in the presence of AGO deputies and central directors, and important issues discussed about AGO today. The first issue included in the agenda was the letter of Laghman Appellate Prosecution Office.
The Laghman Prosecution Office had asked for instruction about cases concerning article 39 of the Law on Elimination of Violence against Women that do not require to processing anymore. It is predicted in the Law on Elimination of Violence against Women and the Criminal Procedure Code that in some situations, the Appellate Prosecution Offices could order the dismissal and closure of the cases due to lack of reasons for continuation litigation. The Laghman Appellate Prosecution Office had asked for instruction where to archive these cases.
The High Council of AGO decided to archive the cases in the Statistics and Analysis Departments of the provincial prosecution offices and that the accurate report on proceedings of these cases sent to the Department of Research and Studies and the Prosecution Office for Elimination of Violence against Women.
The second issue in the agenda was recommendation of AGO Provisions Enforcement Directorate regarding the presidential decree about the convicts who benefit from the presidential remission decrees, but these people were convicted for crimes against internal and external security. The High Council of AGO decided to exclude these people from benefit of the remission decree.
Afterward, the High Council of AGO discussed and decided about the case of Dadullah s/o Atah Mohammad, a citizen of Kandahar province. Based on the suggestion of Kandahar Appellate Court, Dadullah accused of kidnapping or paving the ground for kidnapping of Ms. Mariam but there is no accurate information about the status of Mariam at the prosecution office. The court decided to release Dadullah on valid guarantor until determining Ms. Mariam’s whereabouts; however, Dadullah could not provide the guarantor. Kandahar Appellate Prosecution Office asked the High Council of the AGO for instruction either to release him or not. The High Council of AGO decided that the proceedings carried out in accordance with article 110 of the Criminal Procedural Code.
The case of Kamran Alizai, Director of Herat Provincial Council, also discussed in this meeting. AG Mohammad Farid Hamidi stated that the mentioned person’s job was suspended and banned from travel abroad due to investigation. Since Mr. Alizai is under investigation and considering all the necessary stages, all precautionary measures have to abrogate and his case referred to the court soon. The court will issue its verdict regarding the issue.
