AGO Completed the Case of Rape on a Midwife in Samangan
Investigation from 10 of the suspects of Abkhorak clinic’s case of Samangan province has been completed by the Attorney General’s Office (AGO) of the Islamic Republic of Afghanistan.
On 16th of May 2019 a nurse at Abkhorak clinic in Roodab district of Samangan province was gang-raped by ten of the local people.
According to the report, four of the suspects are underage and six others are adult (above 18 years old).
The case was investigated by Samangan’s Attorney Office, department for Anti-Violence against Women and Juvenile Delinquency.
Based on the findings of the assigned prosecutor, the victim midwife served for six years at this clinic. He cited that in addition to the harassment, beating, and rape the defendants has stolen her cash and jewelry too.
The defendants had also beaten the father of the midwife and a patient who was in the clinic at that time.
The assigned prosecutor for this case, demand for implementing the 1st, 2nd, 3rd and 4th paragraph of Article 17 and 23 of Eliminating Violence against Women Law and Articles 640 and 641 of Code of Penalty for the crime of rape and Article 59 and 73 for the Harassment.
For one of the suspects in this case who played the intimidation role, Article 29 of the EVAW Law has been considered for him by the assigned prosecutor.
From the other hand, for those underaged suspects of this case, Article 17 of EVAW Law and Article 97, 98, 640 and 641 of the Penalty Code was demanded by the assigned prosecutor.
It has been said that the suspects of this case is in detention and order for arresting the head of the clinic has been also sent to the security organs.
Meanwhile, the Attorney General’s Office (AGO) of the Islamic Republic of Afghanistan has investigated 2701 cases of violence against women in 2018, of which 195 cases are rape.
