Ex-Chairmen of IEC & ECC and Eight Commissioners Jailed for Five Years

Ex-Chairmen of IEC and ECC along with eight commissioners of electoral commissions were trialed in a public hearing on 3rd of September 2019 at the Anti-Corruption and Justice Center (ACJC).

Gula Jan Abdul Badi Sayaad, Ex-Chairman of the Independent Election Commission (IEC), Maazullah Dawlati, Ex-Deputy of the IEC in Admin Affairs, and Rafiaullah Baidar, Abdul Qadir Quraishi, Sayad Hafizullah Hashimi, Maliha Hassan and Wasima Badghisi the Commissioners of the IEC and Abdul Aziz Aryaiee, Ex-Chairman of the Election Complaint Commission (ECC), Homaira Haqmal, Ex- Deputy of the ECC and Abdul Basir Fayeez a commissioner of the ECC were charged over illegal changes of the vote counts on last October parliamentary election.

Their trial started on 2nd of September 2019 and finally on the next day, after reviewing the lawsuit filed by the assigned prosecutor and hearing the advocate lawyers of the defendants, the court in accordance with the First Paragraph of Article 432, 435, 57 and Article 59 with observing the Sixth Paragraph of Article 112 of the Criminal Procedure Code sentenced each one of them for five years of imprisonment.

Meanwhile, Sayad Ibrahim Saadat, former Head of the IEC IT department and Ahmad Shah Zamanzai former Chief Secretariat of the IEC who were charged for abuse of power were found innocent by the court in accordance with Article 5 of the Penalty Code and observing the Article 5 and 435 of the Criminal Procedures Code and lack of evidence.
