Two individuals acquitted of the charge of smuggling 41.375 kilograms of gold from Afghanistan to the United Arab Emirates.
Bashir Ahmad Siddiqi, son of Nasir Ahmad, and Mohammad Rafi Baha, son of Ghulam Bahauddin, who had been convicted of smuggling 41.375 kilograms of gold during the previous government, have been acquitted by the Supreme Court of the Islamic Emirate of Afghanistan.
Mohammad Rafi Baha and Bashir Ahmad Siddiqi were arrested by the U.S. intelligence team (SIGAR) on August 4, 2017, while attempting to transport nine gold ingots to the United Arab Emirates (Dubai) at Bagram Airport. Their case was referred to the Primary Court of the Anti-Corruption Justice Center of the previous government
As a result, on October 22, 2019, each of them was sentenced by the Anti-Corruption Justice Center to four years of imprisonment and fined 100,000 Afghanis, with an order for the confiscation of 41.375 kilograms of gold.
After the victory of the Islamic Emirate of Afghanistan, Mohammad Rafi Baha and Bashir Ahmad Siddiqi appealed to the esteemed office of the Prime Minister of the Islamic Emirate of Afghanistan. Their case was subsequently referred to the Attorney General’s Office, the Kabul Appellate Court, and finally, to the Dar Al-Efta of the Supreme Court. By ruling number 503, dated June 23, 2023, the court ordered the return of 41.375 kilograms of gold and lifted the travel ban imposed on Mohammad Rafi Baha and Bashir Ahmad Siddiqi.
