Two of the Abductors of a Child were sentenced to Death

Samiullah, a seven years old boy who was kidnapped on the 2nd of February 2019 from district 12 of Kabul city and was killed after the abduction.

Mohammad Yar, Rahat Gul, Sefatullah, Rafiaullah, Ahmadullah, and Sayad Hassan were charged in this case. This case was fully investigated by the AGO and after that, it was referred to the court by the assigned prosecutor.

The Judicial Hearing of the Preliminary Court was held in the presence of both sides of the case and the defendants’ advocates on the 3rd of September 2019.

During the hearing, each one of the individuals, Ahmadullah son of Mohammad Qasim and Sefatullah son of Shafiq involved with this abduction cases, and killing of Saimullah have been sentenced to death in accordance with Paragraph 1 and 3 of the 1st clause of Article 547 and in observance of Article 598 of the Penalty Code.

Furthermore, the Judiciary Hearing has sentenced to custodial imprisonment of 30 years each one of the individuals, Rafiuallah son of Sayad Hassan, Rahat Gul son of Mohammad Gul and Mohamamd Yar son of Zafar Khan in regards to this crime in accordance with Paragraph 1 and 3 of the 1st clause of Article 547 and in observance of Article 598 of the Penalty Code.

After the court announced its decision, the assigned prosecutor accepted the court’s ruling on the execution of Ahmadullah and Sefatullah. However, he objected to the court’s ruling on the case of others.

From 2016 to 2018, a total of 574 abduction cases including 1033 defendants and suspects has been investigated by the Prosecution Office of Anti-Crime against Internal and External Security. Among these, 37 of the defendants were sentenced to death and the rest of them were sentenced from 6 months to 30 years of imprisonment. It should be mentioned that among these three of the defendants have always been executed.

It is noteworthy that recently the Attorney General’s Office (AGO) of the Islamic Republic of Afghanistan has been following these cases seriously in order to support the private sector and investment and as well as for fair investigation of the abduction cases. In addition to investigating such cases, the AGO has launched a number of joint conferences and meetings with investors.

Based on the findings of these conferences and meetings and the proposal made by the AGO a “Committee for Supporting Private Sector” which includes members from the Judicial Sector operating under security and intelligence entities was also formed.
