ACJC Convicted Three Persons on the Charges of Abusing Duty and Falsification

Three persons were publicly convicted by the Anti-Corruption and Justice Center (ACJC) on October 1st, 2019.

Abdul Hamid Hakimi, son of Abdul Qadir, Deputy of Police Special Unit of Ministry of Interior, Habib Rahman, son of Ghulam Ali, Director of Emran Habib Company and Mir Aqa, son of Mohammad Rasoul, deputy director of Emran Habib Company were convicted.

The Judicial Board sentenced Abdul Hamid Hakimi on the charge of abusing his duties, involvement on 19 cases of falsification, 40 cases of using fake documents, partnership in paying bribery and absenteeism following the Paragraph 2 of Articles 285, 39, 255 and Paragraph 2 of Article 48 of the Penalty Code with the observance of Article 237 of Criminal Proceeding Law with consideration Paragraph 1 of Article 443, 439, 73 and 17 of the Penalty Code and Paragraph 10 of the first issuance of the mentioned Code to Seven Years and Six Months Custodial Imprisonment, 50,000 AFN cash fine, and payment of 80,000 US$ along with the other convicted persons to the government.

Based on the decision of the Judicial Board, Habib Rahman was convicted on the charges of partnership for abusing of duty in accordance to Paragraph 2 of Article 285 and 39 of the Penalty Code with consideration of Paragraph 1 of Article 14 and 17 of the Penalty Code to five years and six months custodial imprisonment and also convicted Mir Aqa on the charge of 20 cases of falsification and partnership on abusing duty following the Article 439, 73 and 17 of the Penalty Code to Five years custodial imprisonment.

The Judicial Board of the hearing also ordered based on Article 14 of the Penalty Code for repaying of 249 million and 266 thousand and 533 AFN against the defendants.
